Online Course Terms

These Online Course Terms apply when you purchase, receive, access or use an online course provided by Natalie Martin through nataliemartin.com.au.

They should be read together with our website Terms of Service, Refund Policy and Privacy Policy. If these Online Course Terms are inconsistent with our general Terms of Service in relation to an online course, these Online Course Terms will apply.

In these terms, “we”, “us” and “our” refer to Natalie Martin. “You” and “your” refer to the person purchasing, receiving or accessing a course.

By purchasing or accessing a course, you agree to these terms.

1. About our courses

Our online courses are self-paced educational courses designed to help students develop their watercolour, mixed media and creative skills.

The content included in each course is described on the relevant course product page at the time of purchase. Depending on the course, this may include:

  • prerecorded video lessons

  • downloadable e-books

  • reference images

  • materials lists

  • templates, exercises or project notes

  • access to a student community

  • bonus lessons or other supplementary materials.

Course inclusions, running times and required materials vary. Please read the relevant course description carefully before purchasing.

Unless expressly stated otherwise, art materials, equipment and internet access are not included in the course price.

2. Course suitability and results

We aim to describe each course, its level and its content as clearly and accurately as possible.

Creative learning is personal, and individual experiences and results will vary depending on factors such as your previous experience, materials, available time and amount of practice.

Purchasing or completing a course does not guarantee a particular artistic, personal, professional or commercial result.

Nothing in this section limits your rights if a course does not match its description or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.

3. Purchasing and payment

Course prices are displayed on the relevant product page and during checkout. Unless stated otherwise, prices are displayed in the currency selected on the website and include applicable Australian GST.

Payment must be successfully completed before course access is provided.

Discounts, promotional offers and coupon codes are subject to any conditions displayed with the offer. Unless we agree otherwise, discounts cannot be applied retrospectively or exchanged for cash.

If you purchase a discounted course bundle, the discount applies to the bundle as a whole. Individual courses within the bundle cannot ordinarily be returned or exchanged separately, except where required by law or agreed by us.

4. Receiving course access

Course access is generally provided using the email address entered at checkout.

Depending on when and which course you purchased, access may be delivered through Teachable, Tevello, Shopify or another nominated course platform.

You are responsible for:

  • providing a complete and accurate email address

  • checking your inbox and junk or spam folders for access emails

  • creating and maintaining any required student account

  • keeping your login details secure

  • contacting us if you do not receive access or experience a technical problem.

5. Lifetime access

Where a course is advertised as including “lifetime access”, this means:

  • your enrolment does not have a set expiry date

  • you can access and revisit the course without paying a recurring course fee

  • access will continue for as long as we operate and support that course and have the right and practical ability to provide it.

“Lifetime access” does not refer to the lifetime of the purchaser or guarantee that a particular website, hosting platform, video format, student community or individual lesson will remain unchanged indefinitely.

We may update course content, replace outdated lessons, change the course platform or make reasonable changes to how a course is delivered. If we change platforms, we may require you to create a new account or take reasonable steps to transfer or reactivate your access.

We will not materially reduce the course you purchased without an appropriate reason or remedy. If we permanently discontinue a paid course, we will provide reasonable notice where possible and take reasonable steps to offer continued access, replacement content or another appropriate remedy, having regard to the age of the purchase and your rights under the Australian Consumer Law.

Changes to these terms will not remove rights that had already accrued under an earlier purchase.

6. The 30-day satisfaction guarantee

We want you to feel confident choosing a course. In addition to your rights under the Australian Consumer Law, eligible online courses include a 30-day satisfaction guarantee where this is advertised on the course product page.

Under this guarantee, if the course does not meet your expectations, you may request a refund within 30 calendar days of the date your course access was first issued.

To request a refund, email info@nataliemartin.com.au and include:

  • your name

  • the email address used for the order

  • your order number, if available

  • the name of the course.

You do not need to prove that the course is faulty to use the satisfaction guarantee. We may invite you to tell us why the course was not right for you so that we can improve it, but providing detailed feedback is optional.

If your request is received within the 30-day period:

  • we will refund the amount you paid for the eligible course

  • any promotional discount applied to the purchase will be reflected in the refunded amount

  • the refund will generally be returned to the original payment method

  • if you paid using a gift card, the applicable amount will generally be returned to that gift card

  • your access to the refunded course and its downloadable materials will be cancelled.

Please allow time for your bank or payment provider to process the refund after it has been issued.

The guarantee applies once per person, per course. It must not be used to repeatedly purchase, copy or complete substantially all of a course and then repurchase the same course after receiving a refund.

Course bundles

If you purchase a digital bundle containing two or more courses, the 30-day satisfaction guarantee applies to the bundle as a whole. A refund under the guarantee will cancel access to all courses included in that bundle.

Courses bundled with physical products

If a course is purchased with a painting kit or another physical product, the satisfaction guarantee applies to the online course component.

The physical product component is governed by our Refund Policy and your rights under the Australian Consumer Law. We will explain any amount attributable to the physical product before processing the course refund.

If we offer the option to return an unused physical product for a refund of the complete bundle, we will provide return instructions. This does not affect your rights if the physical product is faulty, damaged or incorrectly supplied.

Bonus gifts

If your course purchase included a physical bonus gift, we may ask you to return an unused bonus item when receiving a refund. Where we require its return, we will provide instructions and cover reasonable return postage. Your statutory rights are not affected.

Requests outside the 30-day period

The voluntary satisfaction guarantee ends after 30 calendar days. However, your rights under the Australian Consumer Law may continue beyond that period.

Nothing in these terms limits your right to a remedy if the course is faulty, materially different from its description, not provided with due care and skill, or otherwise fails to meet an applicable consumer guarantee.

7. Australian Consumer Law

Our courses come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

The 30-day satisfaction guarantee is an additional promise offered by us. It does not replace, restrict or limit any right or remedy you may have under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a remedy if:

  • the course is materially different from its description

  • course access is not provided

  • a significant technical problem prevents you from accessing the course

  • the service is not supplied with due care and skill

  • the course is not reasonably fit for a purpose you made known to us before purchasing.

Please contact us first so we have the opportunity to investigate and resolve the problem within a reasonable time.

8. Personal-use licence

Purchasing a course gives you a limited, personal, non-exclusive and non-transferable licence to access and use the course for your own learning.

Your purchase does not transfer ownership of the course content or any intellectual property rights to you.

Unless we give you written permission, you must not:

  • share your account or login details

  • allow another person to access the course using your account

  • copy, record, reproduce or distribute course videos

  • upload course content to another website, platform or file-sharing service

  • sell, sublicense or commercially distribute course materials

  • remove copyright notices or Natalie Martin branding

  • use the course or its materials to create or deliver another class, workshop, course or teaching resource

  • reproduce Natalie Martin’s artwork or reference images for commercial sale

  • use course content to train an artificial intelligence system or create a competing product.

One enrolment is intended for one student unless a group, school or organisational licence has been agreed with us in writing.

9. Your artwork

You are welcome to share photographs of the exercises and artwork you create while completing a course, including in the student community and on social media.

Where your work closely follows a course project, Natalie Martin artwork or supplied reference image, we appreciate an acknowledgement that it was created as part of a Natalie Martin course.

Unless we expressly give commercial permission, Natalie Martin’s original artwork, course demonstrations, templates and supplied reference images may not be reproduced as products, prints, merchandise, teaching materials or artworks for commercial sale.

These restrictions do not prevent you from using the general skills and techniques you learn to create your own original artwork from your own ideas and reference material.

10. Downloads

Downloadable materials are provided for your personal learning and remain protected by copyright.

You may download and print a reasonable number of copies for your own use. You must not share, reproduce, sell, publish or distribute those materials to another person.

If your course access is cancelled or refunded, you must stop using the course materials and delete any downloaded copies, except for records you are legally entitled or required to retain.

11. Student community

Some courses include access to a student Facebook group or another online community. Community access is an additional benefit and is not guaranteed to remain on a particular third-party platform indefinitely.

When participating, you agree to communicate respectfully and not:

  • harass, threaten or discriminate against another person

  • publish unlawful, abusive or misleading material

  • share another student’s personal information or artwork without permission

  • post spam or unauthorised advertising

  • share course content with people who are not enrolled

  • infringe another person’s intellectual property or privacy.

We may remove content or suspend community access where reasonably necessary to protect students, comply with the law or enforce these standards.

Where appropriate, we will notify you of a concern and give you a reasonable opportunity to address it. Serious misconduct may result in immediate removal.

Removal from a student community does not automatically entitle you to a refund for the course itself, unless required by law.

12. Account security and misuse

You are responsible for activity conducted through your student account and should contact us promptly if you believe your account has been accessed without permission.

We may temporarily suspend access while investigating suspected account sharing, unlawful activity, security risks or a serious breach of these terms.

We will not permanently cancel paid course access without a reasonable basis. Except where immediate action is reasonably necessary, we will notify you of the issue and give you an opportunity to respond or correct the breach.

Nothing in this section limits any refund or other remedy you may be entitled to under the Australian Consumer Law.

13. Technical requirements and interruptions

You are responsible for having a suitable device, compatible software and a reliable internet connection.

We cannot guarantee that course platforms will operate without occasional interruption. Access may be temporarily unavailable because of maintenance, platform updates, internet outages or circumstances outside our reasonable control.

We will take reasonable steps to restore access and assist with technical issues within our control. If an interruption becomes substantial or cannot be fixed within a reasonable time, we will consider an appropriate remedy in accordance with the Australian Consumer Law.

14. Third-party services

Our courses may use services provided by Shopify, Tevello, Teachable, video-hosting providers, Facebook and other third-party platforms.

Your use of those platforms may also be subject to their own terms and privacy policies. We are not responsible for changes made independently by a third-party provider, but we remain responsible for providing the course you purchased and will take reasonable steps to maintain or restore access.

Personal information is handled in accordance with our Privacy Policy.

15. Gifts and transfers

If a course is purchased as a gift, the recipient must create their own student account and agree to these terms.

Course access is for the named recipient and cannot be shared.

Before a gifted course has been activated, we may allow it to be transferred to a different recipient. Please contact us for assistance. Once a course has been accessed, it cannot ordinarily be transferred unless we agree otherwise or the law requires it.

For gifted courses, the 30-day satisfaction guarantee begins when course access is first issued to the purchaser or nominated recipient, whichever occurs later.

16. Limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, we are not responsible for loss caused by:

  • your use of course content contrary to our instructions

  • materials or equipment selected or used by you

  • circumstances outside our reasonable control

  • an outcome that was not promised or represented as part of the course.

You are responsible for using art materials safely and following any manufacturer safety instructions, including instructions relating to ventilation, skin contact, storage and use around children or pets.

17. Changes to these terms

We may update these Online Course Terms when reasonably necessary, including to reflect changes to our course platform, services or legal obligations.

The terms applying at the time of your purchase will continue to govern that purchase unless a later change benefits you, is required by law or you agree to the change.

We will not use an update to remove an existing right or materially reduce a course you have already purchased without an appropriate reason and remedy.

18. Governing law

These terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws, including the Australian Consumer Law.

Nothing in this section prevents you from exercising any right you may have under the laws that apply to you as a consumer.
